The Court of Appeal, Abuja Division, on Thursday, dismissed an appeal by Chief Edozie Njoku and Chinedu Okoro challenging the judgement of its Kano Division delivered on August 10, which had affirmed Chief Victor Oye as the National Chairman of the All Progressives Grand Alliance.
Ruling on the appeal marked CA/AW/256/ 2021, filed against Barrister Sylvester Ezeokenwa and five others, the appellate court held that the appeal constituted an abuse of court process.
In a unanimous decision, the court said considering the principle of starre decisis, it was bound by the judgement of Kano Division of the Appeal Court delivered on August 10, which had affirmed Chief Victor Oye as the National Chairman of the All Progressives Grand Alliance.
Dismissing the appeal, the panel said it lacked the jurisdiction to entertain the suit, because doing so, “will amount to this court sitting on appeal over its own judgement”.
“This appeal is incompetent and is dismissed for want of jurisdiction.
“This is a final judgement and parties are bound by the outcome except to appeal at the Supreme Court.
“Consequently, the sum of N10million has been awarded against the appellant, in favour of the 1st and 2nd respondents.
Justice Jummai Sankey gave the lead judgment.
